  1. General
    1. The opportunities offered by the management of the Masters of Realism to participate in art fairs (hereinafter ‘the fair’ or ‘fairs’) concern various fairs on different dates, at various locations in various places, initially in the Netherlands and later also abroad.
    2. The fairs offer artists who have been selected as Masters of Realism one or more exhibition spaces in special fair stands exclusively for the Masters of Realism, in order to show realistic paintings to a large audience, make contacts with interested parties and sell the work to visitors of the fairs during and after the fairs.
    3. The organization of the fairs is provided by various companies. The organization of the special fair stand for the Masters of Realism is provided by the management of the Masters of Realism.
    4. The costs for renting the special fair stand are borne by the management of the Masters of Realism.
    5. Artists who want to present themselves at fairs where the Masters of Realism have a special fair stand, accept these General Terms and Conditions fully and unconditionally
  2. Applying for participation
    1. Masters of Realism register for participation in a fair according to the procedure as indicated on the website of the Masters of Realism.
    2. Applications for participation are confirmed insofar as the special fair stand offers space. Confirmations take place in order of registration.
    3. Participants will receive further information about the details of participation with or shortly after a confirmation of participation. In the run-up to the fair, participants will generally receive several e-mail messages about their participation.
    4. Participants must take note of the information sent and respond to it if desired.
    5. The artists who cannot be admitted as participants will be notified by e-mail. Any participation fees paid will then be fully refunded.
    6. Additional facilities, such as spotlights and a chair, may be offered. If additional facilities are offered, they are available as long as supplies last and possibilities allow. If an ordered extra facility is not (no longer) available, this will be communicated as soon as possible to the participant who has requested one or more extra facilities.
  3. Changing and cancelling participation by participant
    1. Expansion of participation can be requested in writing by the participant up to 30 days before the fair takes place. Increasing the number of exhibition spaces is free of charge, with the exception of the extra costs for the extra exhibition space. A request for expansion can only be honored if the fair stand (still) offers space for it.
    2. Reduction of participation can be requested in writing by the participant up to 30 days before the fair. Reductions are only accepted with the approval of the management of the Masters of Realism. In the event of a reduction in the stand, € 45 (excluding VAT) in processing costs (including confirmation, administration and adjustment of the layout) will be due.
    3. Cancellation of participation must be done in writing to the management of the Masters of Realism by e-mail or regular mail. Cancellation is usually confirmed within five working days by the management of the Masters of Realism.
    4. In case of cancellation within 14 calendar days after registration, no costs are due.
    5. In case of cancellation up to four months before the (first day of the) fair takes place, 30% of the total participation costs are due.
    6. In case of cancellation up to two months before the fair, 50% of the total participation costs are due.
    7. In case of cancellation less than two months before the fair, the full participation costs are due, regardless of the reason.
    8. If a participant does not exhibit on one or more days of the fair without deregistering, the full participation costs are due, regardless of the reason.
  4. Communication with visitors to the fair
    1. Participants may speak to visitors during the exhibition in the immediate vicinity of their exhibited artworks.
    2. Participants may hand out folders, postcards and/or business cards to visitors.
    3. Participants may make appointments with visitors that effectuate the sale or rental of their work during and after the fair.
  5. Presentation options and layout of the stand
    1. Each participant gets the exhibition space reserved for him or her in the form of one or more hard walls in the fair stand of the Masters of Realism at his or her disposal.
    2. The management of the Masters of Realism determines where and how the various artworks are hung in the special fair stand
    3. The participant can be assisted with the delivery of the works to be exhibited and during the setup of the exhibition space. Assistance from the participant is also permitted when collecting the works and dismantling the exhibition space.
    4. If the exhibition space can be enlarged, this will be subject to a fee determined by the management of the Masters of Realism.
    5. In the stand, hanging works are generally attached with perlon cords, hanging hooks and adjustable hooks. Cords and hooks are made available by the management of the Masters of Realism.
    6. Unless otherwise indicated, under no circumstances may drilling, screwing, etc. be carried out in the walls of the exhibition space. Only stickers provided by the management of the Masters of Realism may be stuck on the walls.
    7. For the use of, among other things, name badges, the exhibition walls, hanging systems, a table and/or chair and any other rented extras, a cash deposit of € 50 is due at some fairs, which will be fully refunded in cash after the fair upon undamaged return of all goods made available.
    8. Caused damage, for example to the exhibition walls and/or rented materials, will be recovered from the relevant participant and, insofar as the deposit is sufficient, will be deducted from the deposit.
    9. Due to the desired peace and harmony in the stand, the use of self-brought spotlights, chairs and tables is not permitted.
    10. It is not permitted to place or hang works and any chair and/or table outside the stand space without explicit permission from the management of the Masters of Realism.
    11. In some cases, the outside and/or back of the stand can (also) be used for exhibiting work. In those cases where this is possible, a fee indicated by the management of the Masters of Realism is due for this.
    12. The management of the Masters of Realism has tables available that can be rented. The rental of a table includes a black cover cloth for a beautiful, peaceful presentation.
    13. A maximum of 1 table and 1 chair are allowed per artist.
    14. Only in the stand, directly at one’s own works, against the wall, a maximum of 1 name mention (name artist, website and the like) is allowed. An extra name indication may not be larger than 15 cm high and 40 cm wide.
    15. If the management of the Masters of Realism provides name indication in the stand, a maximum of 25 letters and characters can be placed on the nameplate. If more letters and characters are desired, more nameplates must be made or smaller letters and characters must be used. Costs are due for extra nameplates.
    16. The walls of the stands are 2.5 meters high. All works must fit within the rented exhibition space in width and depth.
    17. There is a minimum space of 10 cm between the works to be exhibited.
    18. For the sake of peace in presentation and a professional appearance, it is not allowed to place works on the floor.
    19. Exhibiting works above and below each other is not permitted without written permission from the management of the Masters of Realism. The works must be exhibited next to each other. This is also for the sake of peace in presentation and a professional appearance.
    20. It is not allowed to offer consumptions, other than those of the caterer, in the stand.
  6. Quality of the artworks
    1. Participants can largely determine which works are exhibited themselves. There are no restrictions regarding materials used and age.
    2. Participants may only exhibit and offer for sale self-made art at the fair.
    3. The works to be exhibited must be dry (paint/glue).
    4. The works to be exhibited must be fully exhibition-ready, i.e. framed (or stretched) and equipped with a solid hanging system.
    5. Formats of the artworks: works may be a maximum of 200 cm high and must fit within the rented exhibition space(s) in width and depth.
    6. The management of the Masters of Realism has the right to refuse the exhibition of one or more artworks. In this case, there is no compensation from the management of the Masters of Realism, nor is the management of the Masters of Realism obliged to make its motives known.
  7. Delivery and collection
    1. The stand must be set up on the day or days before the first day of the fair within the time period indicated for this by the management of the Masters of Realism. The times at which the works must be hung in the stand will be announced to the participants well in advance.
    2. If the stand is set up outside the indicated time period, € 100 (excluding VAT) in extra costs will be charged.
    3. Unsold artworks must be taken or collected after the fair. Collection outside these times at a possible deviating location costs € 100 (excluding VAT). The management of the Masters of Realism is not liable for any damage that has arisen after the indicated collection times.
    4. If the artworks are not collected on the day and time indicated above, storage costs will be due. These amount to € 10 per work per day for the first seven calendar days, starting on the last day of the fair. After that € 5 per work per day (amounts are exclusive of VAT).
    5. If a work has not been collected three months after the fair, it will be forfeited free of charge to the management of the Masters of Realism.
  8. Sale and rental of exhibited works
    1. The exhibited artworks may be offered for sale and for rent and sold or rented on the spot or later.
    2. The participant determines the selling prices and rental prices of the exhibited artworks himself. These are inclusive of VAT and are stated on the stickers that the participants receive from the management of the Masters of Realism and that the participants can stick to the artworks.
    3. No commission is due to the management of the Masters of Realism for sale or rental.
    4. If an exhibited work has been sold or rented and is taken directly by the buyer or tenant, the sold or rented work may be replaced by another work that is accepted for exhibition at the fair by the management of the Masters of Realism. If the work is not taken along, the sale or rental is made known on or at the work, preferably with a red sticker.
    5. If not the participant, but the management of the Masters of Realism effects and/or handles a sale or rental, € 80 in administration and processing costs will be charged to the participant.
  9. Mentions of names of participants and publication of images of works
    1. The management of the Masters of Realism will mention the names of the participants in the manner and places desired by it.
    2. These mentions are free of charge for the participants, unless explicitly agreed otherwise in advance. If there are costs associated with mentions, these will be explicitly communicated to the artists concerned, whereupon the artists are free to give or not give permission for this.
    3. Participants grant the management of the Masters of Realism the right to use images of their works without further permission and without compensation for publication to promote the fair, in particular to promote the special fair stand for the Masters of Realism and the Masters of Realism participating in the fair.
  10. Insurance
      1. From the moment the artworks are hanging that a participant exhibits in the stand of the Masters of Realism, until the moment the artworks have been removed from the wall of the stand at the end of the fair, they are covered by the insurance taken out by the management of the Masters of Realism.
      2. A maximum insured amount of € 7,500 applies per claim, with a deductible of € 250.
      3. The further conditions imposed by the insurance on the works to be insured and everything related to them apply.
      4. Compensation for material damage takes place insofar as it is covered by the insurance. Non-material damage, including emotional damage, is not insured.
      5. The management of the Masters of Realism does not bear any liability for matters other than the exhibited artworks and only insofar as these are covered by the insurance.
  11. Costs
    1. No participation fees are due for participation in the fair, in the special fair stand of the Masters of Realism, with 1 work, the size of which falls within the indicated sizes.
    2. Participation in the fair in the special fair stand of the Masters of Realism is possible with a maximum of 3 works, the size of which falls within the indicated sizes, as long as there is space available in the special fair stand.
    3. Participation fees are due for participation with more than 1 work.
    4. The participation fees are announced by the management of the Masters of Realism to the participants upon registration for participation. The costs are explicitly stated on the registration form.
    5. It is possible to opt for certain additional services or products. These are generally subject to costs.
    6. Any discount never applies in combination with another discount; the highest discount applies.
    7. The participation fee must be paid upon registration for the fair, unless otherwise agreed in writing.
    8. All amounts mentioned in these General Terms and Conditions are exclusive of VAT, unless stated otherwise.
  12. Liability, suggestions and complaints
    1. The management of the Masters of Realism is constantly striving to improve all aspects of participation in the fairs where the Masters of Realism is present with a special exhibition stand. Suggestions for improving the service are highly appreciated.
    2. Despite the great care taken to fulfill agreements made, it may happen that the management of the Masters of Realism makes a mistake. Complaints must be submitted in writing to the management of the Masters of Realism within ten days after the reason for the complaint arose. In all cases, a complaint will be responded to within fourteen days.
    3. Under no circumstances are individuals liable for actions of the management of the Masters of Realism. In case of disagreements, complaints and other matters that may be current, the legal entity within which the management of the Masters of Realism falls, De Kunst Collega’s B.V., can be addressed.
    4. Liability is limited in all cases to the sum of the participation fees.
    5. The management of the Masters of Realism is not liable for any damage whatsoever to works of art, at any time: not during the exhibition, not during storage, and not during transport, nor on the way to or from the fair. Insurance can be taken out for damage to and theft of the exhibited works of art.
  13. Other provisions
    1. The management of the Masters of Realism and any third parties engaged by it are not liable for any damage, direct and/or indirect, arising from or in any other way related to the design, care and execution of the exhibition opportunities at the fairs where the Masters of Realism is present with a special exhibition stand.
      In the event that works are damaged by the management or employees of the Masters of Realism, the damage will be compensated to the extent that it is covered by the insurance.
    2. Despite the care that the management of the Masters of Realism devotes to the execution of the agreed services, it is possible that the information provided and/or displayed is incomplete or incorrect. Printing, spelling or other errors in the material published by the management of the Masters of Realism, of any nature whatsoever, cannot be attributed to the management of the Masters of Realism and cannot in any way imply an obligation for the management of the Masters of Realism.
    3. Provisions and measures taken by the organizers of the fairs in which the Masters of Realism participates, apply to participation.
    4. If a fair in which the Masters of Realism participates has to be canceled, postponed, adjusted or shortened, as a result of force majeure or unforeseen circumstances, such as fire, storm damage, flooding, terrorist threat, disaster in the fair location (for example, a bomb threat or risk of collapse), a government measure, inaccessibility of the fair location, threat of war or an epidemic/pandemic, the management of the Masters of Realism can under no circumstances be held responsible for the consequences. In these cases, participants cannot claim compensation or restitution of amounts due and/or paid for participation. In such cases, the management of the Masters of Realism will make every effort to still have a canceled fair take place at a later date or to offer participants participation in one or more other fairs.
    5. The management of the Masters of Realism reserves the right to exclude a participant from participation if the participant in question acts in any way contrary to these General Terms and Conditions, or in the opinion of the organization is seriously offensive with behavior, with the works to be exhibited or otherwise. Exclusion from participation may also follow when actions are taken contrary to the spirit of the General Terms and Conditions.
    6. Agreements between the management of the Masters of Realism and the participant that deviate from these General Terms and Conditions only apply if they have been laid down in writing.
    7. The provisions worded in these General Terms and Conditions can be adjusted at any time without further notice. Agreements made before the adjustment remain in force with the conditions applicable to the adjustment.
    8. If an article of these General Terms and Conditions does not apply, the other articles will remain in full force.
    9. This version of the General Terms and Conditions is effective from 1 February 2024. The Dutch version of the General Terms and Conditions applies. Translations serve as a guide for those who do not speak Dutch.
    10. In cases of disagreement about the interpretation of what is laid down in these conditions, the opinion of the management of the Masters of Realism is decisive.
    11. In cases where these conditions do not provide, the management of the Masters of Realism will judge and act reasonably.
    12. Any dispute regarding the validity, interpretation, execution or termination of these conditions will be settled exclusively by the court in Breda.
